Definitions

• “Affiliate” Any entity controlling, controlled by, or under common control with GMB Advance.

• “Profile” The Customer’s Google Business Profile (GMB/GBP) or any other online business listing managed by GMB Advance.

• “Platform” The systems, strategies, and tools used by GMB Advance for profile setup, SEO, and optimization services.

• “Service” GMB profile setup, optimization, and local SEO provided by GMB Advance.

• “Intellectual Property Rights” All patents, copyrights, trade secrets, trademarks, and related rights owned or used by GMB Advance.

License; Use of Service

• GMB Advance provides services to enhance local business visibility on Google.

• Results may vary based on competition, customer engagement, and Google algorithm updates.

• GMB Advance does not guarantee specific rankings, leads, or revenue outcomes.

• Customers agree to use services only for legitimate business purposes.

• Any resale, duplication, or misuse of GMB Advance’s strategies or content is strictly prohibited.

Prohibited Activities

Customers must not use GMB Advance services for:

• Illegal, misleading, or offensive business activities

• Copyright or trademark infringement

• Spam or fraudulent practices

• Violation of Google’s or any platform’s policies

• Tampering with delivered SEO work or reports

Registration & Customer Responsibility

• To use GMB Advance services, Customers must provide accurate business information (Name, Address, Phone, Website, Category, etc.).

• Customers are responsible for providing access to their GMB/GBP account if needed.

• Customers must ensure accuracy of provided details and remain compliant with Google policies.

Intellectual Property

• All methods, content, strategies, and systems created by GMB Advance remain the exclusive property of the Company.

• Customer business content (logos, images, descriptions) remains the property of the Customer.

• Feedback, testimonials, or suggestions provided by Customers may be used by GMB Advance for service improvement or marketing.

Third-Party Services

• GMB Advance may use Google, Bing, Meta, or other third-party tools to deliver services.

• These services are subject to their own terms and policies.

• GMB Advance is not responsible for interruptions, penalties, or policy changes imposed by third parties.

Fees & Payment Terms

• Service fees will be agreed upon in the Order Form or Proposal.

• Payments must be made on time to ensure uninterrupted service.

• Late payments may result in suspension of services.

• All fees are non-refundable unless otherwise stated.

Customer Representations

By availing GMB Advance services, Customers confirm that:

• They are authorized to represent their business.

• Their business complies with applicable laws and regulations.

• They will not provide false or misleading information.

Confidentiality

• All confidential business data shared by Customers will remain private.

• GMB Advance will not disclose such data to third parties unless legally required.

• Customers agree not to disclose any proprietary strategies or methods of GMB Advance.

Warranty Disclaimer and Limitations

• Services are provided “as-is.”

• GMB Advance does not guarantee uninterrupted results, permanent rankings, or fixed traffic numbers.

• The Company is not liable for:

  • Google updates affecting rankings

  • Customer’s misrepresentation of business details

  • Indirect, incidental, or consequential damages

• Maximum liability shall not exceed the total fees paid by the Customer.

Term & Termination

• Either party may terminate services with written notice.

• GMB Advance may suspend or terminate services for:

  • Violation of these Terms

  • Policy breaches with Google or other platforms

  • Non-payment of fees

• No refunds will be issued upon termination, except at the Company’s discretion.

Data Collection & Usage

• GMB Advance may collect business-related data (e.g., insights, reports, analytics) for performance tracking.

• Data may be stored and processed in compliance with applicable laws.

• Customers are responsible for ensuring they have rights to any content submitted.

General Provisions

• Amendments: These Terms may be updated with a 7-day prior notice.

• Waiver: No right or clause shall be waived unless in writing.

• Severability: Invalid clauses shall be adjusted or removed without affecting the remaining Terms.

• Notices: All communication must go through the contact form on the official website.

• Governing Law: These Terms are governed by the laws of the State of Uttar Pradesh. The courts of Lucknow shall have exclusive jurisdiction.

• Assignment: Customers may not transfer or assign services without written approval from GMB Advance.
